Acceptable Use Policy



1. What's in this policy?

This acceptable use policy sets out the content standards that apply when you upload content to our platform, make contact with other users on our platform, link to our platform, or interact with our platform in any other way. It should be read alongside our platform terms of use for experts add link and customers

2. Prohibited uses

You may not use the Consultz platform:

● if you are under 18;
● in any way that breaches any applicable local, national or international law or regulation;
● in any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect;
● for the purpose of harming or attempting to harm minors in any way;
● to bully, insult, intimidate or humiliate any person;
● to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;
● to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
● to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
● in any way that involves child sexual exploitation or abuse; or
● to upload any content that incites, racism, violence, extremism, or discrimination in any form.
● to offer any financial scheme regulated or otherwise.
● to offer any adult or sexual services of any kind.
● to sell services, subscriptions or products of any other platform.
● to advertise third party services other than those relating to your expertise and field of authority.

You also agree:

● not to reproduce, duplicate, copy or re-sell any part of our platform in contravention of the provisions of our terms of use;
● only use the platform for the purposes it was intended. The exchange of knowledge and advice between users and experts.
● to address any and all disputes within the framework of the company’s rules, procedures and the platform.
● not to contact clients outside of the platform.
● not share client’s details.  
● not to access without authority, interfere with, damage or disrupt:
o any part of our platform;o any equipment or network on which our platform is stored;
o any software used in the provision of our platform; or
o any equipment or network or software owned or used by any third party.


3. Service Standards

Consultations

Experts are responsible for conducting consultations through Consultz in a professional manner that does not put Consultz into disrepute. All content and knowledge remain the property of the expert. Consultz withholds the right to suspend or delete expert profiles, without notice based on reviews and feedback from users, to ensure a high quality of service and level of expert.

Authorisations

Experts must not offer any financial advice unless they are authorised by a regulatory authority such as the FCA (UK) or FMA (Europe); in which case they must state clearly state and represent these in their profile qualifications.

Discrimination

Consultz does not tolerate discrimination based on personal attributes such as age, gender, gender identity, disability, religion, ethnicity, race, colour, national origin or sexual orientation.
Offensive to Good Taste

Consultations must not be offensive to good taste. This means discussions must not be, for example, hateful, vulgar, sexually suggestive or violent. In special circumstances, Consultz may determine that a conversation that was acceptable is no longer appropriate as we update our policies to reflect new laws or clarify our position.

Fraud and Deception

Consultations must not be fraudulent or deceptive. The service offered by an expert must accurately match the content of their profile. Any claims in an expert's profile must have factual support. Experts should not make deceptive or inaccurate claims about competitive products or services or imply their services are affiliated with or endorsed by others without their permission. Experts should not advertise prices or offers that are inaccurate.

Intellectual Property Infringement

Experts must not use trademarks belonging to third parties unless express permission has been granted by the trademark owner. Experts should not use trademarks, logos, service marks or company names in a way that would be confusing, or imply an affiliation or endorsement when there is none. Consultations must not use materials in which third parties hold the copyright unless express permission has been granted by the copyright owner.

Experts may use the Consultz logo and assets to advertise their services with the express note that this is in no way an endorsement from the company, it is licensed specifically for the promotion of the expert's availability through the platform only.

4. Content standards

These content standards apply to any and all material which experts or customers contribute to the Consultz platform (Contribution).

The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.We will determine, in our sole discretion, whether a Contribution breaches the Content Standards.

Requirements

A Contribution:

● must be accurate (where it states facts);
● only contain opinions that are genuinely held; and
● must comply with the law applicable in any country from which it is posted and to which the website is targeted.A Contribution must not:
● be defamatory of any person;
● be obscene, offensive, hateful or inflammatory;
● bully, insult, intimidate or humiliate;
● encourage, promote or provide instructions for deliberate self-harm;
● encourage, promote or provide instructions for suicide;
● encourage, promote or provide instructions for an eating disorder or behaviours associated with an eating disorder;
● promote sexually explicit material;
● include child sexual abuse material;
● incite violence or hatred against particular groups;
● promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
● include content that would be considered a criminal offence under laws relating to terrorism, child sexual abuse material, racism or xenophobia;
● infringe any copyright, database right or trade mark of any other person;
● include video content that has been or would be likely to be given an R18 certificate by the British Board of Film Classification (BBFC);
● include video content not suitable for BBFC classification;
● include material that might impair the physical, mental or moral development of persons under the age of 18;
● be likely to deceive any person;
● breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
● contain illegal content or promote any illegal content or activity;
● be in contempt of court;
● be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
● be likely to harass, upset, embarrass, alarm or annoy any other person;
● impersonate any person or misrepresent your identity or affiliation with any person;
● give the impression that the Contribution emanates from Wealth Dragons Group PLC , if this is not the case;
● advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse;
● contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; or
● contain any advertising or promote any services or web links to other sites.

Video content

For the avoidance of doubt, for any Contribution in the form of video content:
● you must tell us immediately if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material);
● you must not upload a video containing harmful material;
● you must not upload a video containing advertising for any of the following:
o cigarettes and other tobacco products, electronic cigarettes or electronic cigarette refill containers, and prescription-only medicine; oro for alcoholic drinks that are not aimed specifically at under 18s and do not encourage immoderate consumption of alcohol;
o drugs or other banned substances, medical treatments or access to them.
● any advertising included in a video you upload must not:
o prejudice respect for human or animal dignity;o include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation;
o encourage behaviour prejudicial to health or safety;
o encourage behaviour grossly prejudicial to the protection of the environment;
o cause physical, mental or moral detriment to persons under the age of 18;
o directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity;
o directly encourage such persons to persuade their parents or others to purchase or rent goods or services;
o exploit the trust of such persons in parents, teachers or others; or
o unreasonably show such persons in dangerous situations;
● you must use the functionality provided on our platform to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.

5. Breach of this policy

When we consider that a breach of this acceptable use policy has occurred, we may take such action as we deem appropriate.  Failure to comply with this acceptable use policy constitutes a material breach of our platform terms of use add link upon which you are permitted to use our platform, and may result in our taking all or any of the following actions:

● immediate, temporary or permanent withdrawal of your right to use our platform;
● immediate, temporary or permanent removal of any Contribution uploaded by you to our platform;
● issue of a warning to you;
● legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
● further legal action against you; or
● disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.We exclude our liability for all action we may take in response to breaches of this acceptable use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

Prohibited and Restricted Services

1. Prohibited Services

Consultations in connection with the following matters are prohibited:

● illegal products, services and activities;
● fake documents and related services;
● tobacco products - this includes selling or promoting, directly or indirectly, any tobacco products (such as cigarettes, pipes, cigars), alternative tobacco products (such as e-cigarettes or vaporizers), or any related equipment that facilitates the use of tobacco. Lawful products and services which promote quitting tobacco are permitted;
● illicit or recreational drugs;
● weapons, ammunition, fireworks or any other violent product or service;
● adult content, including ads for adult products and services;
● counterfeit goods;
● gambling or sweepstakes of any kind;
● fortune telling, dream interpretations and individual horoscopes are prohibited, except when the emphasis is on amusement rather than serious interpretation;
● unrealistic or misleading claims about health improvements, including those related to diet and weight loss, are prohibited. Consultations promoting unhealthy or unsafe behaviours, such as excessive consumption of an item, are also prohibited. We reserve the right to restrict advertising related to any health matter;
● affiliate advertising - experts may not run in-stream video ads within their profiles without Consultz’s prior authorisation;
● political matters - including consultations advocating for or against a particular candidate, party, or ballot proposition or otherwise intended to influence an election outcome; ads fundraising for or by political candidates, parties, political action committees or similar organizations, or ballot propositions; and ads exploiting a sensitive political issue even if the advertiser has no explicit political agenda;
● sensitive events – matters that are inappropriate during the time of or in relation to a tragedy, disaster, or similarly sensitive event; and
● products or services for hacking, cracking or circumvention.

2. Restricted Services

Consultations in connection with the following matters are restricted as set out below:
● alcoholic products - only available in certain countries.
● animal products – we reserve the right to limit promotions for animals or animal products and promotions for products related to endangered species are prohibited;
● dating services - such promotions may never be targeted at members under 18. The dating services must be legal in the applicable jurisdiction and must not engage in “escort type” services where any person is compensated to participate in the date. We reserve discretion to determine the appropriateness of the service;
● soliciting funds – we allow promotions that solicit funds only if they comply with applicable laws and would qualify as tax deductible or charitable in the applicable jurisdiction;
● prescription drugs - require prior authorisation and consultations may only promote prescription drugs in the following jurisdictions: United States. Such ads must not target customers under 18 years of age;
● over-the-counter drugs - require prior authorisation and consultations may only promote over-the-counter drugs in jurisdictions where it is legal and must adhere to all applicable laws and regulations. Such ads must not target members under 18 years of age;
● medical devices and medical treatments - consultations may only promote medical devices and medical treatments where it is legal and must adhere to all applicable laws and regulations. Such ads must not target members under 18 years of age;
● short-term loans, financial services, promotions for payday loans, paycheck advances or similar short-term loan products; and
● buying, selling or trading of cryptocurrencies.





Changes to this policy

This privacy notice was last updated on 28 February 2024. We may change this policy from time to time and when we do we will inform you via our website.
